Waiver & Release Agreement – Lagreemixx llc
The individual named below (referred to as “I”, “me” or “you”) desires to enter the fitness studio (the “Premises”) operated by Lagreemixx llc., a Nevada corporation d/b/a Studio Remixx to engage in recreational and fitness activities/classes (the “Activity” and “Class”).
As lawful consideration for being permitted by Lagreemixx to be on the Premises and engage in and participate in the Activity, I agree to all the terms and conditions set forth in this document (the “Agreement”).
1. Assumption of Risk: I fully understand and acknowledge that my participation in the Activity and my use of any equipment on the Premises has: (a) inherent risks, dangers, and hazards, and may result in injury or illness to me including, but not limited to bodily injury, death or other ailments that, could cause serious disability; and (b) these risks and dangers may result from or be compounded by the actions, omissions, or negligence of others, including Lagreemixx representatives, employees, or volunteers, and other persons on the Premises. By participating in the Activity, I acknowledge that certain injuries are possible and that the foregoing injuries may be caused by slips, falls, and other gravity-related mishaps, equipment failure, overstraining, or exceeding physical limitations, human error, disregard for guidelines, rules, and standard practice, ignorance or inattention. I ACKNOWLEDGE THAT I AM VOLUNTARILY ENTERING THE PREMISES TO ENGAGE IN THE ACTIVITY WITH KNOWLEDGE OF THE DANGER INVOLVED. I HEREBY AGREE TO ACCEPT AND ASSUME ALL RISKS OF PERSONAL INJURY, ILLNESS, DISABILITY, DEATH OR PROPERTY DAMAGE, ARISING FROM MY BEING ON THE PREMISES OR ENGAGING IN THE ACTIVITY, AND ALL RESPONSIBILITY FOR ANY LOSSES AND/OR DAMAGES WHETHER CAUSED BY THE NEGLIGENCE OF LAGREEMIXX OR OTHERWISE.
2. My Representations and Warranties: I represent and warrant that: (a) I am in good health and have no impairment, injury, disease or ailment preventing me from engaging in exercise or which would cause increased risk of injury or adverse health consequences to myself or others as a result of use of the fitness facilities and/or fitness equipment at the Premises in any manner; (b) It is my responsibility to consult a physician before engaging in this or any fitness program; and (c) No physician, general practitioner or other medical care provider has ever informed me that I have a heart condition, high blood pressure or other medical, physical or mental condition that would prevent me from properly and safely engaging in the Activity; and (d). I have not been advised by a physician to limit my physical activities and I am not under the influence of any medication or substance that would prevent such participation; and (e) The instructions and advice of instructors is not to be construed by me to be medical advice; and (f) If in the opinion of Lagreemixx my access or participation may endanger my health then Lagreemixx may (but is not obligated to and is not assuming any duty to me with respect thereto) deny me access and the right to participate until I furnish a letter from my physician stating that in the opinion of such physician I am medically and physically able to participate in the Classes.
3. Release; Indemnity: I, on behalf of myself, my personal representatives, and heirs, agree to release and discharge Lagreemixx and its affiliates from all Claims for injury, property damage, illness, medical costs, or death arising from my presence on the Premises or participation in Activities. I will indemnify and hold Lagreemixx and its affiliates harmless from any Claims related to this agreement, including third-party Claims. I agree not to bring any Claims against Lagreemixx or its affiliates and release them from any liability related to such Claims.
4. Communications. By signing this waiver, I agree to opt in and allow Lagreemixx to contact me via email for communication regarding my account, my classes and pricing offers for future promotions. Should you choose to opt-out, all promotional Lagreemixx emails have an opt-out option that allows me to remove myself from the Lagreemixx list that alerts clients for special offers and pricing.
5. Class Policies.
(a) Cancellations: Cancellations made less than 10 hours before the start of class will be considered late. For all unlimited monthly memberships and 2 Week Intros, a $15 fee, a late cancellation will incur a $15 fee. If on a package, you will lose the class.
(b) No Shows: For all unlimited monthly memberships and 2 Week Intros, no shows will incur a $25 fee. If on a package, you lose the class and incur a $15 fee.
(c) Instructors: Please note that when you purchase classes, you are paying for a class and not an instructor. Instructors are subject to change without notice.
(d) Gear: Socks with grips are required for each class for safety and sanitary reasons. We have them for sale if you do not bring your own.
(e) Personal Property: Lagreemixx is not responsible for any damage or loss to any vehicle or for its contents when it is parked or left on or near the premises, or for any damage or loss of your personal property which you bring to the Premises.
(f) Services (Classes, Workshops, etc) Refund Policy: All service sales are final, no refunds.
6. Photo, Media, and Copyright Release: I grant permission for Lagreemixx to take photographs and/or videos or audio recordings of me during classes or private instruction sessions. I understand that these images and videos will remain the property of Lagreemixx and may be used for advertising, marketing, and promotional purposes. I acknowledge that I will not be identified by name unless I provide explicit consent, and I forfeit any right to compensation or ownership of these images and videos. I can revoke permission by providing written notice of my revocation to Lagreemixx.
I HAVE READ THE ABOVE AGREEMENT AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT, WAIVE AND RELIEVE LAGREEMIXX FROM LIABILITY FOR PERSONAL INJURY, ILLNESS, DISABILITY, PROPERTY DAMAGE, LOSS OF SERVICES OR DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
